Z - Draft Rule R162-202-5-1 February 2007 Draft Mortgage Licensees  This rule would make persons inelligible to apply for any mortgage license with the Division if they have been convicted of, entered a plea in abeyance to, or completed any sentence or confinement on account of any: 1. felony within five (5) years preceding the application, or 2. misdemeanor involving fraud, misrepresentation, theft, or dishonesty within three years preceding the application.
Z - Draft Rule R162-204-1-2-1 February 2007 Draft   This rule would clarify that the owners and directors of a mortgage company have an affirmative responsibility to maintain the records of that entity after it has closed it’s doors. A motion indicating the Commission’s support for the rule was adopted.
Z - Draft Rule R162-205-2-1 February 2007 Draft   Residential Mortgage Standards of Practice - This rule would require each loan file to contain: 1. A copy of the loan officer’s license, and 2. A signed disclosure by both the loan officer and the borrower (to be signed at application) stating the name, license number and attestation the license is active and in good standing. This rule is designed to increase the importance of the license in the mind of the public and in the mind of the loan officer. It is also intended to help in the enforcement of unlicensed activity, particularly in the 3rd party origination of government loans.
Z - Draft Rule R162-207-6 February 2007 Draft   This rule would prohibit the renewal of any license if the applicant had been convicted of or entered a plea in abeyance to a felony.
